Il s\u2019applique \u00e0 tous les membres, et est annex\u00e9 aux statuts de l\u2019association.<\/p><p style=\"text-align: center;\">Les dispositions du pr\u00e9sent r\u00e8glement int\u00e9rieur doivent \u00eatre interpr\u00e9t\u00e9es \u00e0 la lumi\u00e8re des statuts de l\u2019association. En cas d\u2019ambigu\u00eft\u00e9 ou de contradiction, les statuts s\u2019appliquent par priorit\u00e9 sur le r\u00e8glement int\u00e9rieur.<\/p><p style=\"text-align: center;\">\u00a0<\/p><p style=\"text-align: center;\"><strong>TITRE I \u2013 MEMBRES DE L\u2019ASSOCIATION<\/strong><\/p><p style=\"text-align: center;\"><strong><u>Article 1 \u2013 ADHESION DE NOUVEAUX MEMBRES<\/u><\/strong><\/p><p style=\"text-align: center;\">L\u2019association peut \u00e0 tout moment accueillir de nouveaux membres.<\/p><p style=\"text-align: center;\">L\u2019adh\u00e9sion est libre et ouverte \u00e0 tout postulant d\u00e9sirant y adh\u00e9rer. Pour devenir un membre de l\u2019association, chaque postulant doit soumettre sa demande d\u2019adh\u00e9sion par \u00e9crit \u00e0 l\u2019adresse\u00a0<a href=\"mailto:secretariat@nanomesurefrance.fr\">secretariat@nanomesurefrance.fr<\/a>. Le postulant doit alors remplir le bulletin d\u2019adh\u00e9sion soumis par le secr\u00e9tariat de l\u2019association et prendre connaissance des statuts et du pr\u00e9sent r\u00e8glement int\u00e9rieur.<\/p><p style=\"text-align: center;\">Une fois le bulletin d\u2019adh\u00e9sion compl\u00e9t\u00e9, le secr\u00e9tariat de l\u2019association s\u2019assure de la validit\u00e9 de la candidature du postulant (cf. Article 7 des statuts de l\u2019association) et, dans la positive, le postulant est tenu de s\u2019acquitter de la cotisation pr\u00e9vue (cf. Article 2). Tout postulant devra accepter int\u00e9gralement et sans r\u00e9serve, sur la base d\u2019une attestation dat\u00e9e et sign\u00e9e, les statuts de l\u2019association, ainsi que le pr\u00e9sent r\u00e8glement int\u00e9rieur. L\u2019adh\u00e9sion est alors effective d\u00e8s la date de r\u00e9ception, constat\u00e9e par le secr\u00e9tariat de l\u2019association, du paiement de la cotisation de l\u2019adh\u00e9rent.<\/p><p style=\"text-align: center;\">En cas de refus d\u2019adh\u00e9sion, l\u2019association motivera les raisons du refus.<\/p><p style=\"text-align: center;\"><strong><u>Article 2 &#8211; COTISATIONS<\/u><\/strong><\/p><p style=\"text-align: center;\">L\u2019adh\u00e9sion de nouveaux membres est soumise au versement d\u2019une cotisation, dont les montants sont pr\u00e9cis\u00e9s dans le tableau 1 et pourront \u00eatre r\u00e9vis\u00e9s chaque ann\u00e9e lors de l\u2019Assembl\u00e9e G\u00e9n\u00e9rale Ordinaire de l\u2019association.<\/p><p style=\"text-align: center;\">La cotisation concerne l\u2019ensemble des membres adh\u00e9rents selon les cat\u00e9gories pr\u00e9cis\u00e9es dans un\u00a0tableau de synth\u00e8se disponible sur demande au secr\u00e9tariat de l&rsquo;association.<\/p><p style=\"text-align: center;\">Les montants des cotisations\u00a0correspondent \u00e0 une adh\u00e9sion en date du 1er janvier de l\u2019ann\u00e9e en cours. En cas d\u2019adh\u00e9sion en cours d\u2019ann\u00e9e, le montant de la cotisation d\u2019un nouvel adh\u00e9rent est calcul\u00e9 au prorata mensuel de la p\u00e9riode restante sur l\u2019ann\u00e9e n (mois d\u2019adh\u00e9sion d\u00fb en totalit\u00e9, quelle que soit la date d\u2019adh\u00e9sion). La cotisation de l\u2019ann\u00e9e n+1 est ensuite due \u00e0 la date du 1er janvier et porte sur une cotisation pleine et enti\u00e8re.<\/p><p style=\"text-align: center;\">Toute cotisation vers\u00e9e \u00e0 l\u2019association est d\u00e9finitivement acquise. Il ne saurait \u00eatre exig\u00e9 un remboursement de cotisation en cours d\u2019ann\u00e9e, quelle qu\u2019en soit la raison.<\/p><p style=\"text-align: center;\">Cette cotisation doit ensuite \u00eatre vers\u00e9e par les membres tous les ans, \u00e0 la date du 1er janvier, afin de r\u00e9it\u00e9rer leur adh\u00e9sion \u00e0 l\u2019association.<\/p><p style=\"text-align: center;\">Chaque membre est avis\u00e9 au 1er octobre de l\u2019ann\u00e9e n de la n\u00e9cessit\u00e9 de renouveler sa cotisation en ann\u00e9e n+1. Sans paiement de cette cotisation, une relance est \u00e9mise \u00e0 l\u2019encontre du membre selon les modalit\u00e9s pr\u00e9cis\u00e9es dans l\u2019Article 8 des statuts de l\u2019association. Si \u00e0 l\u2019issue du d\u00e9lai accord\u00e9, le membre n\u2019a toujours pas proc\u00e9d\u00e9 \u00e0 la r\u00e9gularisation de sa cotisation, il est radi\u00e9 de plein droit de l\u2019association.<\/p><p style=\"text-align: center;\"><strong><u>Article 3 \u2013 DROITS ET DEVOIRS DES MEMBRES DE L\u2019ASSOCIATION<\/u><\/strong><\/p><p style=\"text-align: center;\">Les membres peuvent participer \u00e0 l\u2019ensemble des r\u00e9unions et aux activit\u00e9s propos\u00e9es par l\u2019association, dans la limite, le cas \u00e9ch\u00e9ant, des avantages inh\u00e9rents \u00e0 leur niveau de cotisation (cf. tableau 1). Ils peuvent prendre part aux activit\u00e9s et aux projets de l\u2019association selon les modalit\u00e9s pr\u00e9cis\u00e9es dans les statuts de l\u2019association. Ils s\u2019engagent \u00e0 respecter les statuts de l\u2019association et le pr\u00e9sent r\u00e8glement int\u00e9rieur, les locaux et le mat\u00e9riel fourni par l\u2019association le cas \u00e9ch\u00e9ant.<\/p><p style=\"text-align: center;\">Les membres s\u2019engagent \u00e0 ne pas entra\u00eener de pr\u00e9judice moral ou mat\u00e9riel \u00e0 l\u2019association et\/ou aux autres membres. Ils s\u2019engagent \u00e0 ne pas porter atteinte \u00e0 autrui par des propos ou comportements inappropri\u00e9s.<\/p><p style=\"text-align: center;\">Les membres ont le droit et le devoir de participer ou d\u2019\u00eatre repr\u00e9sent\u00e9s aux Assembl\u00e9es G\u00e9n\u00e9rales de l\u2019association, avec voix d\u00e9lib\u00e9rative pour les membres ayant cotis\u00e9 \u00e0 un forfait Standard, Avantage ou Pilote.<\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 4 \u2013 PROCEDURES DISCIPLINAIRES<\/u><\/strong><\/p><ol style=\"text-align: center;\"><li><em><u>Avertissement<\/u><\/em><\/li><\/ol><p style=\"text-align: center;\">Les membres de l\u2019association sont tenus de respecter les statuts et le pr\u00e9sent r\u00e8glement int\u00e9rieur. A d\u00e9faut, lorsque les circonstances l\u2019exigent, l\u2019association peut d\u00e9livrer un avertissement \u00e0 l\u2019encontre d\u2019un membre qui ne respecte pas les r\u00e8gles \u00e9tablies, dont l\u2019attitude porte pr\u00e9judice \u00e0 l\u2019association, ou encore qui refuse de payer sa cotisation, sans que cette liste soit limitative.<\/p><p style=\"text-align: center;\">Cet avertissement est \u00e9ventuellement donn\u00e9 par le bureau de l\u2019association, apr\u00e8s avoir entendu les explications du membre contre lequel une proc\u00e9dure d\u2019avertissement est engag\u00e9e.<\/p><p style=\"text-align: center;\">Les membres recevant deux avertissements sont soumis \u00e0 une proc\u00e9dure d\u2019exclusion, pour une dur\u00e9e provisoire ou d\u00e9finitive, telle que d\u00e9crite ci-apr\u00e8s.<\/p><ol style=\"text-align: center;\"><li><em><u>Exclusion de l\u2019association<\/u><\/em><\/li><\/ol><p style=\"text-align: center;\">Conform\u00e9ment aux statuts, un membre de l\u2019association peut \u00eatre exclu pour les motifs suivants, cette liste n\u2019\u00e9tant pas limitative\u00a0:<\/p><ul style=\"text-align: center;\"><li>Non-paiement de cotisation\u00a0;<\/li><li>Propos d\u00e9sobligeants envers les autres membres de l\u2019association\u00a0;<\/li><li>Comportement non conforme avec l\u2019\u00e9thique et les valeurs de l\u2019association\u00a0;<\/li><li>Non-respect des r\u00e8gles de concurrence\u00a0;<\/li><li>Non-respect des statuts et du r\u00e8glement int\u00e9rieur de l\u2019association.<\/li><\/ul><p style=\"text-align: center;\">Cette exclusion est \u00e9ventuellement prononc\u00e9e par le bureau apr\u00e8s t\u00e9moignage du membre contre lequel une proc\u00e9dure d\u2019exclusion est engag\u00e9e.<\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 5 \u2013 PERTE DE LA QUALITE DE MEMBRE DE L\u2019ASSOCIATION<\/u><\/strong><\/p><p style=\"text-align: center;\">Dans les autres cas que ceux issus de sanctions disciplinaires comme d\u00e9crits ci-dessus, les membres de l\u2019association perdent \u00e9galement leur qualit\u00e9 de membre en cas de d\u00e9mission, d\u00e9c\u00e8s ou disparition.<\/p><p style=\"text-align: center;\">La d\u00e9mission d\u2019un membre de l\u2019association se fait par lettre recommand\u00e9e, dont la r\u00e9daction est libre, adress\u00e9e au Pr\u00e9sident de l\u2019association. Le membre d\u00e9missionnaire est alors radi\u00e9 de la liste des membres de l\u2019association, et n\u2019est plus redevable des cotisations futures. Aucune restitution de cotisation n\u2019est due au membre d\u00e9missionnaire. Le membre d\u00e9missionnaire conserve la possibilit\u00e9 de renouveler son adh\u00e9sion aupr\u00e8s de l\u2019association \u00e0 tout moment.<\/p><p style=\"text-align: center;\"><strong>TITRE II \u2013 DISPOSITIONS DIVERSES<\/strong><\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 6 \u2013 DEONTOLOGIE ET SAVOIR-VIVRE<\/u><\/strong><\/p><p style=\"text-align: center;\">Toutes les activit\u00e9s de l\u2019association doivent se pratiquer dans un esprit d\u2019ouverture, de b\u00e9n\u00e9volat, de tol\u00e9rance et de respect.<\/p><p style=\"text-align: center;\">Par ailleurs, il ne doit pas \u00eatre fait \u00e9tat de religion, de politique ou de discrimination, quelle qu\u2019elle soit. Les membres s\u2019engagent \u00e0 demeurer mod\u00e9r\u00e9s, consciencieux, calmes et neutres sur le plan politique, philosophique ou religieux, et \u00e0 ne pas faire \u00e9tat de leurs pr\u00e9f\u00e9rences, croyances et id\u00e9aux.<\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 7 \u2013 CONFIDENTIALITE<\/u><\/strong><\/p><p style=\"text-align: center;\">Toutes les discussions, r\u00e9flexions et activit\u00e9s men\u00e9es dans le cadre de l\u2019association sont strictement confidentielles. La communication d\u2019information (sans \u00eatre exhaustive\u00a0: coordonn\u00e9es, projets, compte-rendu de r\u00e9union) devra faire l\u2019objet d\u2019une demande \u00e9crite d\u2019autorisation de diffusion de la part des adh\u00e9rents concern\u00e9s ou impliqu\u00e9s.<\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 8 \u2013 TRAITEMENT DES DONNEES A CARACTERE PERSONNEL<\/u><\/strong><\/p><p style=\"text-align: center;\">Dans le cadre des activit\u00e9s de l\u2019Association, l\u2019Association et ses membres s\u2019engagent \u00e0 respecter la R\u00e9glementation en vigueur applicable au traitement de donn\u00e9es \u00e0 caract\u00e8re personnel et, en particulier, le r\u00e8glement (UE) 2016\/679 du Parlement europ\u00e9en et du Conseil du 27 avril 2016, d\u00eet \u00ab\u00a0RGPD\u00a0\u00bb. L&rsquo;Association NanoMesureFrance s&rsquo;engage \u00e0 ne pas utiliser les informations sur ses adh\u00e9rents \u00e0 d\u2019autres fins que ses activit\u00e9s propres, \u00e0 limiter l&rsquo;acc\u00e8s de ses informations aux seuls membres du bureau de l\u2019Association.<\/p><p style=\"text-align: center;\">Conform\u00e9ment au RGPD, la personne concern\u00e9e, i.e. dont les donn\u00e9es personnelles font l\u2019objet de traitement dans le cadre des activit\u00e9s de l\u2019association, b\u00e9n\u00e9ficie d\u2019un droit d\u2019acc\u00e8s, de rectification, de suppression des donn\u00e9es la concernant, ainsi que des droits de limitation et d\u2019opposition au traitement et \u00e0 la portabilit\u00e9 de ses donn\u00e9es. Ces droits s\u2019exercent en adressant un e-mail au secr\u00e9tariat de l\u2019Association via l\u2019adresse \u00ab\u00a0<a href=\"mailto:secretariat@nanomesurefrance.fr\">secretariat@nanomesurefrance.fr<\/a>\u00a0\u00bb. L\u2019Association r\u00e9pond \u00e0 la personne ayant fait l\u2019usage de ses droits susvis\u00e9s dans un d\u00e9lai d\u2019un (1) mois \u00e0 compter de la r\u00e9ception de la demande. Ce d\u00e9lai peut toutefois \u00eatre prolong\u00e9 de deux (2) mois, compte tenu de la complexit\u00e9 et du nombre de demandes.<\/p><p style=\"text-align: center;\">La personne concern\u00e9e, dispose \u00e9galement d\u2019un droit de recours aupr\u00e8s de la Commission nationale de l\u2019informatique et des libert\u00e9s (CNIL), en cas de violation de la r\u00e9glementation applicable en mati\u00e8re de protection des donn\u00e9es personnelles.<\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 9 \u2013 DROIT DE LA CONCURRENCE<\/u><\/strong><\/p><p style=\"text-align: center;\">Les membres de l\u2019association s\u2019engagent \u00e0 strictement respecter les obligations relatives aux r\u00e8gles de concurrence.<\/p><p style=\"text-align: center;\">Dans ce cadre, les membres s&rsquo;abstiennent de toute discussion, activit\u00e9 ou comportement susceptibles de constituer une violation de toute r\u00e8gle de droit de la concurrence applicable, de leur part ou de la part de tout autre membre actuel ou potentiel. \u00c0 titre d&rsquo;exemple, les membres ne discuteront pas, ne communiqueront pas et\/ou n&rsquo;\u00e9changeront pas d&rsquo;informations commercialement sensibles, en ce compris des informations relatives aux relations fournisseurs-fabricants, aux prix, \u00e0 la strat\u00e9gie marketing ou publicitaire, aux co\u00fbts, aux recettes et aux conditions commerciales.<\/p><p style=\"text-align: center;\"><strong><u>ARTICLE 10 \u2013 ADOPTION, MODIFICATION ET PUBLICATION DU REGLEMENT INTERIEUR<\/u><\/strong><\/p><p style=\"text-align: center;\">Le pr\u00e9sent r\u00e8glement int\u00e9rieur est \u00e9tabli conform\u00e9ment aux statuts de l\u2019association, et est ratifi\u00e9 par le bureau de l\u2019association.<\/p><p style=\"text-align: center;\">Sur proposition des membres ou du bureau de l\u2019association, il pourra \u00eatre proc\u00e9d\u00e9 \u00e0 sa modification lors de l\u2019Assembl\u00e9e G\u00e9n\u00e9rale Ordinaire annuelle, apr\u00e8s ratification selon les modalit\u00e9s d\u00e9crites dans les statuts de l\u2019association. The present internal regulations are sent to all members of the association, as well as to each new member. They apply to all members, and are appended to the association's articles of association. The provisions of the present internal regulations must be interpreted in the light of the association's articles of association. In the event of ambiguity or contradiction, the articles of association take precedence over the internal regulations.   TITLE I - MEMBERS OF THE ASSOCIATION Article 1 - ADHESION OF NEW MEMBERS The association may welcome new members at any time. Membership is free and open to all applicants. To become a member of the association, applicants must submit their membership application in writing to secretariat@nanomesurefrance.fr. The applicant must then complete the membership application form submitted by the association's secretariat, and read the association's articles of association and by-laws. Once the membership form has been completed, the association secretariat checks the validity of the applicant's application (cf. Article 7 of the association's by-laws) and, if so, the applicant is required to pay the membership fee (cf. Article 2). All applicants must fully and unreservedly accept the association's articles of association and the present by-laws, on the basis of a dated and signed certificate. Membership becomes effective on the date of receipt of payment of the membership fee, as recorded by the association's secretariat. In the event of refusal of membership, the association will state the reasons for the refusal. Article 2 - SUBSCRIPTION FEE New members are required to pay a subscription fee, the amounts of which are specified in Table 1 and may be revised each year at the Association's Annual General Meeting. Membership fees apply to all members in the categories specified in a summary table available on request from the association's secretariat. Membership fees apply to members joining on January 1st of the current year. For new members joining during the course of the year, the membership fee is calculated on a monthly pro rata basis for the period remaining in year n (membership month due in full, whatever the date of joining). The membership fee for year n+1 is then due on January 1st, and covers the full membership fee. All fees paid to the association are definitively acquired. No refund will be made for any reason whatsoever during the year. The membership fee must then be paid annually, on January 1st, in order to reaffirm membership of the association. Each member is notified on October 1 of year n of the need to renew their membership in year n+1. Failure to pay this fee will result in a reminder being issued to the member, in accordance with the procedures set out in Article 8 of the association's articles of association. If, at the end of the period allowed, the member has still not paid his\/her dues, he\/she will be automatically expelled from the association. Article 3 - RIGHTS AND DUTIES OF ASSOCIATION MEMBERS Members may take part in all meetings and activities proposed by the association, within the limits, where applicable, of the advantages inherent in their level of membership fee (see Table 1). They may take part in the association's activities and projects in accordance with the terms set out in the association's by-laws. They undertake to respect the association's by-laws and internal regulations, as well as the premises and any equipment provided by the association. Members undertake not to cause moral or material prejudice to the association and\/or other members. They undertake not to harm others through inappropriate comments or behavior. Members have the right and duty to attend or be represented at the association's General Meetings, with voting rights for members who have paid a Standard, Advantage or Pilote membership fee. ARTICLE 4 - DISCIPLINARY PROCEDURES Warning Members of the association are required to comply with the articles of association and the present internal regulations. Failing this, when circumstances so require, the association may issue a warning to any member who fails to comply with the established rules, whose attitude is prejudicial to the association, or who refuses to pay his or her membership fee, without this list being exhaustive. This warning may be issued by the association's executive committee, after hearing the explanations of the member against whom the warning procedure has been initiated. Members who receive two warnings are subject to exclusion, either temporarily or permanently, as described below. Exclusion from the association In accordance with the articles of association, a member of the association may be excluded for the following reasons, this list being non-exhaustive: Non-payment of membership fees; Disparaging remarks to other members of the association; Behavior not in keeping with the association's ethics and values; Non-compliance with competition rules; Non-compliance with the association's articles of association and internal regulations. This exclusion may be pronounced by the Board after the member against whom exclusion proceedings have been initiated has given evidence. ARTICLE 5 - LOSS OF MEMBERSHIP In cases other than those resulting from disciplinary sanctions as described above, members of the association also lose their membership in the event of resignation, death or disappearance. A member may resign from the association by sending a freely-written registered letter to the President of the association. The resigning member is then removed from the association's list of members, and is no longer liable for future subscriptions. No refund of membership fees is due to the resigning member. Resigning members may renew their membership at any time. SECTION II - MISCELLANEOUS PROVISIONS ARTICLE 6 - DEONTOLOGY AND SAVOIR-VIVRE All the association's activities must be carried out in a spirit of openness, volunteerism, tolerance and respect. In addition, no mention may be made of religion, politics or discrimination of any kind. Members undertake to remain moderate, conscientious, calm and neutral on political, philosophical or religious grounds, and not to make public their preferences, beliefs or ideals. ARTICLE 7 - CONFIDENTIALITY All discussions, reflections and activities carried out within the framework of the association are strictly confidential. The communication of information (without being exhaustive: contact details, projects, minutes of meetings) must be the subject of a written request for authorization to distribute on the part of the members concerned or involved. ARTICLE 8 - PROCESSING OF PERSONAL DATA As part of the Association's activities, the Association and its members undertake to comply with the Regulations in force applicable to the processing of personal data and, in particular, Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016, known as the \"RGPD\". The Association NanoMesureFrance undertakes not to use information on its members for any purpose other than its own activities, to limit access to its information to members of the Association's office only. In accordance with the RGPD, the data subject, i.e. whose personal data is processed as part of the Association's activities, has a right of access, rectification, deletion of data concerning him or her, as well as rights to limit and object to the processing and portability of his or her data. These rights may be exercised by sending an e-mail to the Association's secretariat at secretariat@nanomesurefrance.fr. The Association will reply to the person who has exercised his or her aforementioned rights within one (1) month of receipt of the request. However, this period may be extended by two (2) months, depending on the complexity and number of requests. The person concerned also has the right to appeal to the Commission Nationale de l'Informatique et des Libert\u00e9s (CNIL), in the event of a breach of the regulations applicable to the protection of personal data. ARTICLE 9 - COMPETITION LAW Members of the association undertake to comply strictly with obligations relating to competition law. In this context, members shall refrain from any discussion, activity or behavior likely to constitute a violation of any applicable competition law rule, on their part or on the part of any other current or potential member. By way of example, members will not discuss, communicate and\/or exchange commercially sensitive information, including information relating to supplier-manufacturer relationships, pricing, marketing or advertising strategy, costs, revenues and trading conditions. ARTICLE 10 - ADOPTION, MODIFICATION AND PUBLICATION OF INTERNAL REGULATIONS The present internal regulations are drawn up in accordance with the association's articles of association, and are ratified by the association's executive committee. They may be amended at the Annual General Meeting on the proposal of the association's members or officers, after ratification in accordance with the procedures set out in the association's articles of association. Once modified, a copy of the present by-laws will be sent to all members within thirty (30) days of the modification. The present by-laws can be easily modified, provided that the modifications do not alter or call into question the founding principles and rules set out in the association's by-laws.
